According to this NEJM paper Medicare will reimburse $NVO and $LLy same old prices for diabetes , CV and sleep apnea indications. And obesity indication ( huge pool of pts) will be extra. "We didn't even get the courtesy of a response," he said. He also emphasized that Novo is "not a law firm" and would rather spend its time developing medicines than filing lawsuits. However, he argued that the company felt it had "no choice" because Lilly continued running advertisements that Novo believes mislead patients about the relative efficacy of the two companies' obesity medicines. John Kuckelman also suggested this is not an isolated incident. He claimed Lilly has used similar advertising comparisons involving Mounjaro versus Ozempic and even compared its Foundayo with Rybelsus before approval, calling it "a pattern" that ultimately compelled Novo to take legal action.

The advantage for a pharma producer when a product in the BLA procedure is a 12 year market exclusivity period, where biosimilars as reference products will not be approved by the FDA to enter the market.
