Um das nochmal kurz zusammenzufassen, ein substantial consummation des Plans ist noch nicht erfolgt, das effective Date ist erfolgt. So viel erstmal dazu. Hierzu nochmal Auszüge aus dme Docket 2136: E: Post-Confirmation Modification of the Plan. ... the Deptors are hereby authorized to amend or modify the plan at any time prior to the substantial consummation of the plan,... DD: Authorization to Consummate. ... The substantial consummation of the Plan, within the meaning of sections 1101(2)nand 1127 of the bankruptcy Code, is deemed to occur on the first date, on or after the Effective Date, on which distributions are made in accordance with the terms of the Plan to Holders of any Allowed Claims or Interests (as applicable). Macht mit der Info was ihr wollt, manchmal muss man interessante, durch Shills ignorierte, aber wichtige Passagen in Dockets nochmal wiederholen.
