Ich hatte den Fall auch gegoogelt, scheint einfach noch nie vorgekommen zu sein, was ja auch Sinn macht. Wenn es irgendwie auch nur minimal wahrscheinlich wäre, dass das passiert wäre man vsl anders vorgegangen.

Eine Sache dazu, die mir immer noch niemand in den letzten 3 Wochen beantworten konnte: Pursuant to section 1127 of the Bankruptcy Code, any modifications to the Plan since the commencement of Solicitation described or set forth herein constitute technical changes or changes with respect to particular Claims or Interests made pursuant to the agreement of the Holders of such Claims or Interests and do not materially and adversely affect the treatment of any Claims or Interests. Pursuant to Bankruptcy Rule 3019, these modifications do not require additional disclosure under section 1125 of the Bankruptcy Code or the re-solicitation of votes under section 1126 of the Bankruptcy Code, nor do they require that the Holders of Claims be afforded an opportunity to change previously cast acceptances or rejections of the Plan. Was passiert mit den ganzen Aktien und short Kontrakten, wenn die Heilsarmee mit einem Sack voll Geld um die Ecke kommt und den Plan somit über den Haufen wirft??? Ich will ja gar keine Wertung zu abgeben, ob dies ein realistisches Szenario ist. Aber warum kann schon alles verbucht werden, wenn die Fat Lady noch nicht gesungen hat???

Das bezweifel ich ja auch nicht. Im normalen Prozess reicht das nie und nimmer. Das war ja aber von vornherein klar. Mir geht es lediglich hier um die rechtliche Auslegung.

Gibt aber auch Screenshots von Ami Aktionären mit Aktien im Portfolio von vor mehreren Jahrzehnten. Gut, weiß jetzt nicht ob die auch vorher gecancelt wurden, aber ist ja auch kein richtiges Argument für meinen obig beschriebenen Fall.
