Spoiler Alert: Skip ahead to Netlist’s Motion for Partial Summary Judgment, p. 6 at lines 3-7. Bam! This rebuts Google’s pile of crap, succinctly and completely. To explain where we’re at in simple, layperson terms: Google moves for summary judgment and to strike Netlist’s Claim 16 on the ‘912 patent infringement case. The threshold that Google must meet for asserting intervening rights is that Claim 16 was “amended” or “new.” Meaning, without the court first making that finding, their claim for intervening rights dies. Google’s argument, in summary, is that “Claim 16” was literally not included in Netlist’s initial claim, but that Claim 16 was added to the infringement claim later after patent re-examination. And because it was added later, it should be stricken because Google would be unfairly prejudiced if Claim 16 proceeds. Copied: Netlist answers in their Motion for Partial Summary Judgment, by explaining that Claim 16 was basically a repackaged Claim 15, meaning that some text from Claim 15 had to be written as an “independent” claim to appease the examiner; thus, it was literally copied and pasted and named Claim 16. Their Table 1 confirms this. In order to prevail here, Netlist has to show that Claim 16 was “substantially identical” to an original claim in the patent—which they show here. Case law is consistent and clear that, if these are the facts, Netlist wins. However . . . on the question of whether Claim 16 was “new” versus “substantially similar,” the court will almost certainly defer to the PTO’s determination, which can be found in the citation given in my first sentence, above: From PTO: “Claims 2, 5, 7, 9, 16 . . . have been rewritten in independent form maintaining their original scope” (and patent granted).

Im Unternehmen alleine wohl nicht, aber in Kombination dem dem Erwarteten Geld hat das Invest Riesen Potential. Interessant wird für mich wie sich der Kurs in der Zeit entwickelt "nachdem" Netlist das Geld zur Verfügung hat. Das es vorher schon durch die Meldungen steigt ist klar.

Schritt für Schritt. Ich habe Zeit. Sehe viel Potential in dem Unternehmen.

Unter 50 Euro werde ich wohl nicht Verkaufen. Wird zwar noch Dauern, aber die kommen, hab noch 2-3 Jahre zeit bis zum Zahltag.
