In a 154-page report published on Sept. 10, Anthropic detailed how seven Chinese companies were using Claude illicitly on a widespread scale. In one example, Anthropic alleged that DeepSeek relayed requests from engineers building a police surveillance system to Claude. The allegations have raised concerns in Washington and Beijing, though for different reasons. U.S. authorities accuse Chinese developers of training their models with data drawn from more powerful American systems without authorization in a process known as distillation. Beijing is confronting a separate and potentially more serious problem: that the activities might have sent sensitive Chinese military, police and state-owned corporate data to the U.S., violating Chinese data security laws and regulations. The probe comes at a sensitive time for Beijing. President Xi Jinping is due to visit Washington later this week, when he and President Donald Trump are expected to discuss an “AI dialogue,” a mechanism under which both countries notify each other about AI incidents with national-security implications. The investigations are continuing, and the regulator hasn’t decided whether to penalize the companies, they said. Officials are determining the seriousness of the breaches and the intention behind them. CAC, Moonshot and DeepSeek didn’t immediately respond to requests for comment. Anthropic said Moonshot routed more than 23 million exchanges to Claude between May and July. DeepSeek allegedly used a similar method for more than 12 million exchanges over 14 days in July. Customers weren’t told that their requests were being processed by Anthropic, according to the report. In one case, Anthropic said a user it assessed as likely affiliated with the People’s Liberation Army asked Moonshot’s Kimi model to analyze surveillance footage tracking a person across hundreds of police cameras in Southwest China’s Chengdu, including cameras outside PLA facilities and defense-linked institutes. Moonshot allegedly forwarded the request and footage to Claude without the user’s knowledge, according to the report. In these cases, Moonshot and DeepSeek rerouted customers’ requests to Claude without their knowledge and passed over the answers as processed by their own models, Anthropic said. China tightly regulates cross-border data transfer. Companies need the CAC’s approval to send large volumes of data concerning Chinese citizens and companies overseas. The CAC also oversees the review of generative AI model release, giving them visibility into developers’ data, technology and security controls. The regulator has warned the companies that sensitive information must not be sent to U.S. models, including as part of future model development, the person said.
