Bleibt mal locker. Wenn die EU nicht einseitig aus dem Vertrag aussteigen kann, dann heißt deren einzige Option: "Problem mit Geld zudecken". CV wäre in einer durchaus komfortablen Verhandlungsposition. Da hat ein Jurist als CEO auch wieder seine Vorteile: er kennt den Vertrag, und weiß, welche Vorleistungen gedeckt sind und welche nicht. Wenn die operativen Entscheidungen genauso vorsichtig getroffen wurden wie die Kommunikation erfolgt ist, dann kommt das Geld in die Kasse. Der CEO macht definitiv nicht den Eindruck eines Hasardeurs. Zugegeben: ich hatte diese Aspekte bislang überhaupt nicht im Blick.

JustAGame, sorry habe von oben nach unten gelesen und erst danach den verlinkten Vertrag gesehen. Seite 14 1.9.1. kommt evtl in Betracht (überfliege den gerade). Zumindest steht da schonmal, dass beide Vertragsparteien sich bewusst sind, dass es ein Risiko der Nichtzulassung gibt. Sehe das ähnlich wie du, aber es gibt auch Vorteile selbst aus EU Sicht eine Abnahme zu garantieren mMn. Zudem Punkt 1.9.3 garantiert ja eine ausführliche Studie, für die die EU dann ja indirekt mit der garantierten Abnahme auch bezahlt

@venrox: weil jemand, der klar bei Verstand ist, eine Cap einzieht. Behörden sind aber manchmal recht blauäugig unterwegs, was Verträge betrifft, und unterschreiben Sachen, die eine normaler Mensch nie vereinbaren würde. Und dann gilt: "pactae sunt servandae". Auf jeden Fall wäre es affengeil, wenn damit das Risiko der Entwicklung und der Vorfertigung abgedeckt wäre. Ich habe auf den ersten Blick noch nichts gefunden, das eine einseitige Vertragsbeendigung vorsieht. Beim Handyvertrag ist es genauso: Kündigungstermin um einen Tag verpasst, und der läuft gnadenlos nochmal 2 Jahre weiter - mit Verpflichtung, zu bezahlen.
