Das Unternehmen beantragte das MCTO, da es erwartete, dass es nicht in der Lage sein würde, seinen geprüften Jahresabschluss, die begleitende Diskussion und Analyse des Managements sowie die damit verbundenen Zertifizierungen von CEOs und CFOs für das am 31. Dezember 2020 endende Geschäftsjahr (die "jährlichen Einreichungen") gemäß den vorgeschriebenen Bestimmungen einzureichen Frist ist der 30. April 2021. Das MCTO hätte es den Aktien des Unternehmens gestattet, weiter zu handeln, während dem Chief Executive Officer und dem Chief Financial Officer eine Unterlassungsverfügung erteilt wurde. Ein MCTO wurde jedoch nicht gewährt.
