Und die Besetzung des Audit Committees wirft so einige Fragen auf: On May 9, 2024, which was within the cure period granted by Nasdaq in the Notice to regain compliance with Nasdaq Listing Rule 5605(c)(2)(A), the Company appointed each of Mr. Robert Blair and Ms. Judy Lin, both current members of the Board, as additional members of the Audit Committee. Ms. Lin is a chemical engineer and has zero experience in finance and accounting. Her previous jobs were engineering-based. I did run across an article from August 2023 which stated that she owned, at the time, over $4 million worth of SMCI stock. Kann auch genau das Gegenteil passieren. Manchmal gibt es gute Zahlen und alles wunderbar, trotzdem wird verkauft. An der Börse gab es doch mal Sprichwort (Buy good News oder was auch immer haha)))😂

Weil die Zahlen unter den Erwartungen liegen und noch immer die Gefahr besteht, dass kein 10k eingereicht wird. Das das Committee unabhängig ist überzeug viele wahrscheinlich auch nicht. Der unabhängige Wirtschaftsprüfer ist weg, weil er wahrscheinlich sehr wohl Anhaltspunkte für unregelmäßigkeiten gefunden hat

Die neuen Covenants der Banken wurden hier in den letzten Tagen ja dankenswerterweise gepostet. Wer aufmerksam war, konnte lesen, dass vorzeitigen Rückzahlung und "Kautionen" in Cash vorzuhalten sind: "adds a covenant requiring that the Company maintain at least $150 million of unrestricted cash at all times." ... "required the Company to prepay $250 million of the term loans outstanding thereunder"... Ich würde lieber mal den Taschenrechner anwerfen und ausrechnen wie lange sich SMCI noch über Wasser halten kann, als auf "Kackbrezel" zu zocken.
