February 28, 2024: Monsanto has petitioned the full Eleventh Circuit for a second time to reconsider a panel ruling allowing a Georgia doctor’s claims against the company for failing to warn about cancer risks associated with the Roundup weedkiller. The company argues that federal pesticide labeling requirements preempt such state law claims.
The purpose of this doomed effort is to create a split with the Ninth Circuit’s ruling on similar claims, potentially increasing the likelihood of Supreme Court review. Bayer’s options see to be settle these Roundup lawsuits or bet the company on this long shot.
